Gov to reconsider judges’ retirement age

 Gov. Eliot Spitzer wants to reconsider a state mandate that judges retire at the end of the year they turn 70 years old.
 “I’m serious about it,’’ Spitzer told the New York Law Journal (subscription required) after the swearing-in ceremony of New York’s Chief Judge Judith Kaye. “I think it’s an issue we should put on the table.’’
 Spitzer nominated Kaye for another 14-year term. However, she must step down at the end of 2008 because of the mandatory retirement law. (State Supreme Court justices can get extensions to stay beyond 70 in certain circumstances.) A state Bar Association task force would like to push the retirement age to 76.

judges are like everyone else…after 70 they suffer
the same kinds of memory losses and mental lapses
spitzer would be smarter to make older drivers be
retested and to let judges retire at 70…before they
get cranky and lack the pasion necessary for the job
They do however deserve a raise
LIFT THE 70-CAP, AND THE 76-CAP
There is no reason to lose wise judges, when the intellectually stimulating legal process keeps them vital, vibrant and an asset to society. We ought not to force wisdom out of the courthouse; rather, we need to cherish it. Just take a look at the virile and razor-sharp Bob Morganthau, the legendary Manhattan District Attorney, who at 87 is making Manhattan so safe that its tied with Staten Island for the safest in NYC!
Having served on Office of Court Administration’s Task Force on Mandatory Retirement in the late 1990s, then, as now, I believe that it is a waste of precious judicial talent, sharpened by exemplary judicial service, which litigants can ill afford to lose as they seek a merit-based resolution of their dispute, custom tailored to fit the unique facts in every case.
In fact, not only should the 70-cap be lifted, but the 76-cap for Supremes also. Obviously, no judge is forced to serve longer than they want to, especially, given the dismal salary currently paid (which is below what first year wet-behind-the-ears associates make in Manhattan). If we paid the judges $250,000 a year, it would be a bargain for the case load and stress they absorb everyday as they personify the Constitution, and in the appropriate case, say “no” to power.
Indeed, Chief Justice of the United States, John Roberts, has asked for a salary close to $225,000 just so as not threaten the benefits of judicial independence that naturally occur from “life tenure” of the Article III federal judiciary.
Certainly, our state judiciary, carrying a much larger caseload, are no less worthy.
Judicial salaries must be raised if society truly honors the bench for its singularly unique role in our “checks and balances” society beyond merely the words, Your Honor. It is high time to put our money where our mouth is.

This has nothing to do with the alleged sale of judgships
the 9th judicial district has one of the most distinguished
judiciary in the state…scandal has never with one exception many years ago ever been a factor, the issue is
when should a judge retire…right now they are re certified
to sit as JHO’s after 70…they simply do not have the same
authority to settle conflicts..But the point is that by and
large the population as a whole looses cognitive ability
after age 70..and there is no reason not to allow younger
lawyers who aspire to sit on the bench do so…In addition
the law does change over time and younger judges are more
apt to be on the cutting edge of those changes..
most people believe that 72 is too old to be president
that is one reason mccain’s poll numbers are sliding
so lets keep the 70 year retirement age…and continue
to permit those judges who want to continue to serve to do
so as JHO’s ..
