Zherka levels yet another charge at Yonkers

Publisher Sam Zherka is opening a new front in his continuing war with Yonkers. Last month a federal court ruling found City Hall had violated the first amendment rights of the Westchester Guardian, when it swept its news racks from city streets and issued summonses to its employees who were handing out the free weekly newspaper.Now Zherka is calling for Westchester County District Attorney Janet DiFiore to prosecute a couple of top city officials and lower level employees for the incident. On Zherka’s list are Mayor Phil Amicone and Police Commissioner Edmund Hartnett, as well as individual members of the  police department and the city’s Public Works Department who had removed the news racks. Zherka says the city took 56 news racks, but only returned 36, many of which were damaged or destroyed, he said.Zherka still has a series of law suits remaining against the city and is seeking tens of milions of dollars in damages. The confrontation began after The Westchester Guardian published a series of unflattering articles about Amicone last year.

    This guy Zherka is at best a narcissistic crackpot. Or at worst, he could be described as a low-life thug. Take your pick. Why do this guy’s ravings continue to be publicized? Meantime, the really bad sides of him and his behavior are glossed over. He has no credibility and should be treated like the nut job he is.

    lawsuits is the discovery part…so the defendants
    can ask for and get the names of the people who
    advertise and how much they paid..they can get
    the financials to see if there is any injury
    that is probable and of course they can subpoena
    all of the contributions he made to the robertson
    campaign so everyone knows how much he contributed
    making him a public figure..also all of the
    issues of the guardian become part of the record
    to establish the prediliction of the owner/editor
    to influence the outcome of elections through
    the words printed in the newspaper which may
    or may not also count as a political contribution
    triguring the new york state campaign finance
    provisions of the election law

    Hey Mike Edelman, do you or do you not think a crime was committed when Amicone ordered the unlawful confiscation of those news racks. Now lets analyze this. If they didnt act with in the boundaries of the law, that means they broke the law. If they destroyed and damaged the news racks, isnt that a Felony? If they possessed stoled property, isnt that a Felony? Isnt stealing any thing with a value over 1k a Grand Larceny? Do you think Govt. officials should get away with taking, destroying, damaging ones personal property? Its clear Laws were broken, and I support the Prosecution of any and all who break the Law, including Amicone, Hartnett and their cohorts.

    Right on to freedom of speech, whether in The Guardian, or on these message boards. So long as there’s no slander, or libel. I applauded the Judge’s decision last week to allow that rag’s continued appearance on the streets of Westchester. Its owners pay for those spots. The Guardian is not distributed illegally. It is not pornography (though it is really poorly written and edited).

    But The Guardian’s lawyers are succumbing to Shakespeare: “That man doth protest his innocence so much, as to give the appearance of guilt.”

    Zherka is not believable. He makes things up to get attention. As for taking the boxes, that shouldn’t have been done. But they were returned in a couple of days and the judge awarded legal fees only. Now Zherka, the man who cannot be believed at all (proved by what is printed in the Guardian), is claiming something else. Let him run his strip club. He belongs in that sleazy environment.

The fact that the Publisher, Zherka owns a Strip Club, is of no issue in this matter. I have frequented Strip Clubs and most men have also. Im sure most men would love to be where he is and cant be. As far as the Guardian Editiorials, I agree and disagree with them, but thats what makes our Civil Rights so sacred.

    Zherka’s contention as to who said what
    Back to the issue..the people in the Mayor’s office who
    orderd the racks to be taken off the street were dead
    wrong..I said so then on news 12 and I say so now
    And to the extent that the guardian has not received
    all of its racks back (which it has to prove) it should
    recieve money to buy replacement racks…
    why did the guardian wait 7 months to complain about
    how many racks it got back…it should have sent the
    city a bill immediately..thats called an account taken
    and stated.
    Taking the racks by the city although foolish was not
    a criminal act..they believd they were acting according
    to the provisions of their code…in fact the judge
    said they were not…I agree with the Judge as does
    Tim Hayes…but that is not the same as committing a crime
    When Ralph Martinelli published his newspaper he made
    some pretty outragious claims calling basically every
    republican a crook…Now we have the guardian claiming
    similar wrongdoing by various elected officials..no
    question they have the right to do it..However that
    doesn’t make their claims either accurate or factual
    In one of his recent lawsuits Mr. Zherka claims that
    the manhattan county da’s office is invetigating
    him It even charges that the assistant manhattan
    count da said (and this is taken from page 11 so it
    is not my words it is his own attorneys)
    that he (bogdanos)(the ada)told another attorney that is investigating Plaintiff by reason of His “Albanian
    Mob Connection tax fraud, moneylaundering, illicit
    drug dealings and operation of a prostitution ring”
    ....and that he (Bogdanos) isssued dozens of grand
    jury subpoenas ….
    so I have one question…for all of you…Do you
    all think that the Manhattan County DA is doing
    this out of spite, out of politics, or because
    he is interested in conducting the aforesaid investigation
    becuase he has credible evidence that a criminal act
    in NEW YORK CITY was committed….because remember
    the manhattan DA has no jurisdiction for crimes committed
    in westchestre…and why would MR. Zherka put all this
    in his own set of legal papers..I certainly was surprised
    to find he was allegedly being investigated…Could
    all these other law suits merely by a smokescreen
    the best defense is a good offense?
    I would like specific answers to the above
    from those who accuse posters of supporting the mayor
    So did 60% of the voters in yonkers
    the new york times, the journal news and more
    the election is over Robertson lost and so did
    his biggest supporter…sometimes people just can’t
    let it go…but in a democracy particularly ours
    you have to….regardless of where you come from

    It sounds to me like Zherka is desperate and worried about being indicted, and is trying to play defense and deflect attention by going on offense. He is offensive, anyway. In his own legal papers he admits he is being investigated by the Manhattan District Attorney for what would be very serious offenses.

    Why has that big story not been published in the Journal News or anywhere else that I am aware of?

    contents of the papers was not reported…only
    the defendants named like the mayor ..however
    I am like a dog with a bone..since I am named defendant
    which was their biggest mistake. Now the documents
    are public because they are filed with the court I
    want everyone to know that this man who apparently
    owns the VIP strip club IN NY CITY where the investigation
    is taking place, has admitted in the papers that subpoenas
    have allegedly been issued. Unbleievably his papers accuse
    the mayor me as “the consultant” and others whose identity he does not know, as feeding the information to the
    manhattan da…So in an effort to deflect the fact
    of the investigation he has alleged that I for example
    in concert with the others essentially “pursuaded”
    the da in ny to start the investigation…And he
    thinks that he can “enjoin” that investigation…ie
    stop a criminal investigation because of where he
    thinks the information came from…NOT POSSIBLE.Needless to say what they didn’t consider
    was the fact that their allegations will be shown to
    be so outrageous as to undermine any credibility they
    might have in their other lawsuits..For example I have
    never met any of the other bloggers or the da…so it
    would be impossible for me to have conspired to provide
    the da with any information even if I had it…and
    to the extend anyone contacted the DA with information
    of a criminal act, it is not only the obligation of
    the DA to follow up but those communicating the information
    are doing a public service..and you know that an ADA
    in NYC cannot begin an investigation with out his
    superior signing off and without the consent of Bob
    Morganthau the elected DA
    Additionally, and here is where it really gets good
    they have manufactured the blog post which “the consultant:
    allegedly said…and I intend to hold them legally accountable for attributing to me becauase 1. I didn’t
    say it, 2. I don’t think anyone said it, 3. if someone
    did say it it is not on the site anywhere…
    but they have pissed me off…because it was Zherka
    who decided to contribute to robertson and in
    such large amounts, that from a poltical point
    of view he made his participation a huge issue as
    the result of the business he was in, and frankly
    he set himself and robertson up for political attack
    which was my job to do…but now he is playing the
    victim..he will not get away with it

    Sam Zherka not only contributed to Robertson in large amounts through his many corporations, he also formed a PAC he admitted on TV that he did not register. He then aired attack commercials on TV.

    He created false stories in the Guardian, and did more than that, allegedly, including what appears to be giving Robertson free ads in the Guardian which were covered by “contributions” to Dennis Robertson’s campaign in the exact amounts of the costs of those ads, on at least two occasions. At least one of those “contributions” was made by a Zherka partner named Morales.

    Zherka’s activities in Mt. Vernon were similar regarding the Guardian. There is a series of letters between former Mayor Davis’ people and Zherka which is on the internet.

    Zherka contributed to Young’s campaign through at least one of his corporations. The Guardian accused someone in Davis’s office of shredding documents, according to the correspondence, without any proof. The Davis people were outraged by that and other things, and also said Zherka would NOT get slum properties in Mt. Vernon with which he could exploit poor African-Americans. All of that can be found on the internet. It is from Dec. 2007.

    Sam Zherka is a strip club owner and a buyer-investor in slums. What he does with those slums he gets possibly is worthy of investigation by someone.

    that is discoverable…how much he contributed the
    sources whether he failed to follow the election law
    whether he paid taxes on the income he received from
    ad revenues..etc..its all going to fair game because
    he chose to sue me…he should have been a little

    sure len…be glad to respond…if there was a criminal
    act the office of the district attorney would have
    already started a prosecution…To have a crime you
    need mens rea and actus reas..you need the intent
    and the act…workers in the city were instructed to
    confiscate the boxes based on an interpretation of
    the city code…although a federal court find that
    interpretation incorrect…there was no intent to
    steal the boxes…simply to remove them from their
    location..and in fact they were returned..if the
    city damaged them they are responsible for replacing
    them…but there is no basis for a criminal prosecution
    because there was no intent to deprive the owner of the
    boxes ie take them and keep them …plus you cannot
    sue to compel a prosecution..you can attempt to lodge a criminal complaint but it has to be taken and prosecuted
    by the DA..similarly with regard to his other lawsuit
    you cannot civily enjoin a prosecution because you
    allege that some bloggers were responsible for tipping
    of the DA’s office..the DA both in westchester and New
    York is a constitutional office…ie they have the sole
    discretion to prosecute or not….they cannot be
    civlly forced to do so if they don’t think a crime has been
    committed nor can they be civily stopped if they think
    there is reason to believe a crime has been committed
    As you know I was an assistant da for 7 years in westchester
    and I have never seen a situation where a lawsuit was
    used to attempt to coerce the DA into starting a criminal
    prosecution….Once the DA declines that is the end of
    it

    Zherka claims the anonymous bloggers are Yonkers officials. He will go nowhere with any of it, except into a deep pit of his own creation. The Manhattan DA will move to dismiss the case, and Yonkers officials and Edelman will do the same as the DA’s so-called co-conspirators.

    Edelman apparently is counter-suing. Maybe Yonkers will do the same. I have no idea if they will or won’t. But Zherka is suing the Manhattan DA to stop an investigation. That is a demonstration of desperation. He can’t manage any such thing. He can’t stop what he says is a serious criminal investigation of him. And he must have really angered the Manhattan DA with this desperate attempt.

    If Zherka now also claims Yonkers didn’t return 17 of his Guardian boxes, why has he waited since last summer to demand their return or call for prosecution? That is key.

    This sounds like another act of desperation by Zherka to deflect attention. It appears he has sued half the communities in Westchester. He is not credible and files lawsuits like a crazy gadfly or a troubled person looking for attention, else to deflect attention from what he states is a very serious criminal investigation of him in Manhattan.

    Is it not a crime to unlawfully take property with out permission and then to possess it and destroy it while unlawfully possesseing it? I know for sure it is a crime. Amicone committed that crime and he must be prosecuted.

    the intent to deprive him of the property if you
    are not acting under color of a governmental act
    like a code violation..you also have to have the
    intent to keep the property..in this case there
    was no such intent and therefore no criminal act.

    yet Amicone just hired another 2 more people in his office the City is Paying the Electric bill for X2O, he just approved a raise for Lisa Mrijaj, and John the Fibber Fleming, and the City has just agreed to flip the bill for Policing the Raceway. Whats the story with that?

    The real questions remain as to why Zherka is suing anyone. Why wouldn’t he submit a bill for his missing or damaged boxes? How much could that be?

    Why didn’t he say that boxes were missing or damged when they were initally returned?

    Speculator. Zherka sues everybody and anybody. He has dozens of suits filed vs. various Westchester communities and one or more vs. New York City. To me, that says Zherka is not tied too tightly. I’d think many others feel the same way. The guy has “issues,” as the polite saying goes.

    Based on his own legal papers, which the Consultant has quoted from, Zherka also seems to be under a serious criminal investigation right now by the Manhattan district attorney. That might be making him somewhat desperate, to the point of playing defense by going on offense and to try and present himself as the victim of everybody imaginable.

    Ed 10704. I have no idea if what you posted is true or not. I have no inside info on Yonkers or its budget plans. If what you posted is true, and I don’t know if it is or isn’t, it’s you who seems to have inside information. But generally speaking, times are very tight right now. Any community should think about making cuts before raising taxes more than a bare minimum. I think Bloomberg has ordered city-wide budget cuts of about 3 percent in NYC.

    the possible reasons for a lawsuit can be public
    relations based ..the problem is that when attorneys
    use lawsuits for reasons other than the stated ones
    in the complaints..ie when their is no provable cause
    of action although they get an initiail press benefit
    many times they end up having to pay sanctions to the
    court….In my judgment the recent lawsuits are not
    based in any valid legal theory that can be proven
    in a court of law..so the motive for commencing
    them has to be suspect

    I just pulled up a copy of a suit filed in US District Court in White Plains which alleges the following:
    Janet Difiore conspired with a Manhattan assistant District Attorney Matthew Bogdanos to ruin Zherka.

    I know from the past, that she did have an extremely cozy relationship with James E. Kindler who was the bureau Cheif.
    Wow how corrupt Matthew Bogdanos and Janet Difiore are.

    Matthew Bogdanos should be disbarred when this suit comes to fruition. Its called Prosecutorial Misconduct people.

    Its also says that Matthew Bogdanos started this investigation because he is nearing retirement and wants a job at the Law Office of Davis Polk and Wardwell, the law office that Janet Difiore’s husband, Dennis Glazer is a partner in.

    Wow! the allegations are startling.
    There is a conspiracy by a Manhattan Assistant District Attorney “Matthew Bogdanos” the Westchester County DA ” Janet Difiore ” and a partner in one of the nations oldest and most prestigious Law Firms ” Davis Polk and Wardwell”

    according to the Law Suit this is “Free Speech retaliation” Wake up people:
    Matthew Bogdanos, Janet Difiore, and Dennis Glazer in my opinion are corrupt.

    Now the question is where does that leave James E Kindler, Janet Difiore’s very close friend. How involved was he?

    Sources close to the Manhattan DA’s office also have said that several years ago, Janet Difiore had a relationship with one of the ADA’s in the office.

    This sounds like a soap opera, but these are very serious charges. When they are concluded, Janet Difiore, Dennis Glazer, and Matthew Bogdanos should all be disbarred and never allowed to practice law again.

    I hope Robert Morganthau doesnt know about all this. This along with other charges and accusations of Prosecutorial Misconduct will cripple his image and office’s credibility.

    I know Matthew Bogdanos, he has the Napolean complex. He is about 5’Ft 4” inches tall, weighs about 135 pounds. He suffers from small man syndrome.

    He has been known to be self serving. This sounds like some thing he would do, in order to secure a position at the Law Firm of Davis Polk and Wardwell.

    Why am I not surprised to read that Matthew Bogdanos is accused of corruption. As with Elliot Spitzer, this small man, thinks he is ” Holier Than Thou” .

    Some times arrogance destroys you. Could some on please send the suit to me, or let me know where I can get the actual allegations of corruption against Matthew Bogdanos.

    I certainly beleive he is capable of it.
    Matthew Bogdanos is a real bad guy, a true political hack, once all the accusations are proven this man should be disbarred.

    efforts to ti janet di fiore to the manhattan da’s office
    and whatever investigation it is involved in..you left
    out that others were named in A CONSPIRACY…like
    me for example..you also left out that the lawsuit
    completely lied about who made what ineternet blog
    statements…It accuses the consultant of making
    a statement on LOHUD which in fact does not appear
    on lohud anywhere but does appear on THE yONKERS tRIBUNE
    AND IS NOT MADE BY THE CONSULTANT….it also accuses
    the consultant of conspiring with this bogdonos felow
    who he has never met nor spoken to…and this is supposedly
    from a publisher who seeks the truth ..but his legal
    papers are full of half truths and guesses….and I know
    why..zherka supported robertson and I pointed that
    out on tv…I also worked for Janet DIfiore in the last
    election…and Phil Amicone who zherka opposed..so as
    revenge he used his millions to sue me…nice guy
    real upstanding…a seeker of the truth…or a seeker
    of vendetta?

    With Bogdanos’ official reply and everything else, isn’t there enough here to move for a dismissal of this entire bizarre case? That’s a lie about Bogdanos too. His height, and so forth. Let alone the other smears. There is a photo of him, a war hero, no less, in his Wikipedia entry on the net. It can be found on Google by just typing in “Matthew Bogdanos.”

    You have said you are going to counter-sue. And I have said I think you will win that one in a big way. But if you get the Guardian as part of that victory, donate it to a worthwhile charitable or religious publisher. They can at least “exorcise” the presses, which do need it. :)

    If I get the guardian…I will sell the assets and donate
    the entire proceeds to the maria ferrari children’s hospital…and yes the da’s answer is quite fascinating
    bob morganthau’s office is probably the best in the nation
    and the morganthau name is one of the oldest democratic
    party names..His father was the one who convinced Roosevelt
    that the jews were being slauttered in nazi germany
    and I believe the bombing raids over germany were conducted
    to slow down the camps….so you can bet if the morganthau
    office has an investigation going…it was authorized
    at the top…bureau chiefs do not start investigations
    on their own…they meet with the boss outline what they
    have and the boss and only the boss can authorize a grand
    jury to sit..

    by the way is matthew…he was named as michael..indicating
    they are simply taking guesses even about the identity
    of their defendants)...however his answer states as follows
    “apart from his obvious paranoia, Plaintiff posits no plausible explanation why a NY county prosecutor with
    no alleged prior relationship with any of the defendants
    would undertake an unwarranted ciminal investigation
    at their beheset”...the zherka lawsuit makes no factual
    allegations whatever to support any of their claims
    but the larger point is when you build a building if
    the foundation is not stable the building will not
    stand..they chose to start their factual recitation
    with a quote not from LOHUD but from another blog
    site..If they were really interested in finding out
    who uttered the quote why didn’t they subpoean the blog
    site from which it came…AND THE ANSWER IS
    that would not support and would contradict their
    allegation against the consultant…so they chose
    to either intentionally mislead the court or they
    simply didn’t realize at the time they were mixing
    blogs and bloggers…and let me just say one thing
    Under no circumstances do I think it appropriate
    that sam zherka was alleged to be a “kingpin of
    Albanian Organized CRime” so to those bloggers
    who accused him of that shame on you even if
    you are protected by the 1st amendment..zherka
    has never been convicted as far as I know…but
    he has attempted to hold himself out as a publisher
    who speaks the truth which flies in the face
    of what will come out about his first paragraph
    actually paragraph #10….

    Why is it that every where I hear the name Janet Difiore, I hear the word Corrupt. This woman has really exposed herself for who she is.
    The district attorney’s office is no place for politics.
    If this woman has betrayed the publics trust she deserves to be stripped of her duties and sent to prison.

    Janet Difiore should be treated no different than any other criminal who breaks the law.

    You pathetic attempts to install that two-time LOSER Tony Castro into the DA’s office so that he can approve Strip Clubs will fail.

    Here’s an idea worth trying as it has a much better chance of success, get Fidel Castro to run. He is not really in charge of Cuba anymore and so he has lots of free time. He is much more likely to get elected than Tony and I think he likesStrip Clubs too.
