Zherka sues again; This time it’s DA DiFiore

It might be easier to keep track of the public officials and municpalities not being sued by Sam Zherka. This time it’s Westchester County District Attorney Janet DiFiore who is being charged with violating the First Amendment rights of the Westchester Guardian publisher and owner of a real estate empire that includes a Manhattan strip club.
The violation, Zherka says, came in a March 21, 2007 phone call from Janet DiFiore. It left the 6-foot-3 Zherka “chilled in the exercise of his First Amendment protected rights, humiliated, menaced and rendered anxious and upset, and otherwise rendered sick and sore.”
That conversation, according to Zherka’s legal papers, came after the Westchester Guardian published a report about supposed dealings between Independence Party chairman Giulio Cavallo and DiFiore’s husband, attorney Dennis Glazer, concerning the Independence Party’s endorsement in the District Attorney’s race in 2005. I think this shows that Strip Club Sam is mentally ill. What a whack job.
If that is true it in no way excuses the filing of frivolous lawsuits. We really need a change in our legal system.
Loser pays should only be the start because if a person files a lawsuit and that person is mentally ill then what recourse is offered to the next “victim”?
If a person files a lawsuit and loses and has no money they are called “judgment proof” meaning you will never be re-paid the money essentially stolen from you.
If a person files a lawsuit but has no money but the case has merit how are we, as a society to help?
If a rich person spends all their time filing lawsuits how does that serve the public?
We need a fresh look at all these issues, sadly with the large number of attorneys in our legislature it is doubtful that this will come to pass.
Its called Civil Rights people. If the DA doesnt respect them, then she should not hold the office she holds.

pays his lawyer to bring lawsuits…anyone can sue
but you have to prove your allegations and prove damages
to collect…to do that you have to demonstrate a financial
loss by producing tax returns etc…that will be when
all find out how much mr zherka actually spent on
the robertson race…how he spent it..and whether he
filed the appropriate stuff with the board of elections
by the way..failure to file intentionally can be a misdemeanor under state law…that would be the jurisdiction

Nobody in this country can sucessfully sue anyone, anywhere for stating “I think…”

So Sam read a copy of the very liberal NY Times (any day, any year from the dawn of time). It’s way too liberal and does not print the truth, the whole truth, nothing but the truth without leaving out some truth. However read it anyway. It’s a newspaper.
Then go to a library and get a copy of TASS from the old USSR days.
Your rag (which reads like a five year old wrote it) makes TASS look like the NY Times.
The only good thing about your rag is the “mission statement” which is truly, truly, funny.
Not even TASS pretended to be honest but your “mission statement” reads as if you actually interview all sides and then read independent facts and then come to an independent intelligent conclusion.
Of course if that was true people would pay for your rag and then that would be a fact.

I love the Guardian, and so do many many people. It is beyond any doubt a very sought after publication. Its not fluff and it takes free speech to its limits and thats what our great democracy represents. I should ask for a job as a writer. I am a big fan of their courage, and what they stand for. God bless them. Their big win in federal court just solitifies that their suits are not frivelous and after Spitzer, Paterson, Piro, Amicone, Clinton, and Obama, im disgusted with politicians and their lies. When I analyze the hatred you have for this man, and his news paper, the only thing that comes to mind is that you have something to gain by taking the side of elected officials, who for so long have been misleading the public, who have been responsible for many retirees being forced to the work place for fear that they would starve if they did not. Im sure you are not a retiree, living on a fixed income, because if you were, your helplessness would make you feel the same way I and many like me feel about the Guardian. Its a breath of fresh air and a voice for change.

the reporting of “news” requires journalistic integrity
its one thing to report its quite another to editorialize
the guardian is one big editorial…although they claim
to be accurately reporting “news” they are continually
engaged in character assasinations and the facts are
handled from their biased point of view…go take
a look at the fronts of virtually all the issues (I have
them all)...the last issue accused the da of selling
prosecutions…that is an editorial conclusion not

I beleive that the Westchester DA is corrupt. That office has been for so long. We need to bring some one in who upholds and enforces the law no matter what, and that person is not Janet Difiore.
I read that article and it sounds like a news item to me. Janet Difiore has been selectively prosecuting people, protecting her friends and railroading all others.
Janet Difiore along with Andy Spano and other county elected officials are finished. She is not a crime fighter, she is a politician. There should be no place for politics in the office of the highest law enforcement agent in the county and when there is, some ones civil liberties will always be violated and in a free society, that we cannot allow. Janet Difiore is a puppet for the Political Power Brokers which makes her very dangerous. If the Guardian proves that she violated or attempted to violate their first amendment rights, and I think they will, as they proved it in Yonkers, she will be forced to resign.

Is it just a coincidence that Richard Blassberg, the Guardian’s hatchet man who wouldn’t know the word “truth” if he fell on it, worked twice to elect Tony Castro to be the DA—first over Pirro and then over DiFiore? Hard to believe it’s just coincidence.

It was the story of John Henry Faulk, an esteemed broadcaster who was fired owing to his putative left-wing political loyalties on CBS Radio during the McCarthy era.
Faulk was successfully “blacklisted” owing to the vocal protests of a group which implied it had a lot of power, but, in actuality, did not have any money or power.
When Faulk, defended by the great Louis Nizer, presented his case in court, it was proved that the reactionary anti-Faulk parties had very little influence, or money to pay the judgment eventually awarded in his behalf by the judge. They were, in fact, paper tigers.
John Henry Faulk was destroyed by persons with little verve to back up their claims.
This is where we find “The Guardian” in today’s journalism. I’ve been in the journalism business since 1974. I worked for both Randy Hearst and Otis Chandler. I think I may speak here with some knowledge. The Guardian assaults, on a weekly basis, persons who may or may not be corrupt in our county. It leaves blood on each doorstep as it sensationalizes people-
often unfairly- in an attempt to win readers in a Pulitzer/Hearst tradition. You may think of The Guardian as a modern-day “muckraking” machine, in the spirit of I. F. Stone, but, it is not.The Guardian sees many copies distributed throughout Westchester County, but only few are picked up and read. Perhaps its raison d’etre is in need of challenge.
It is The Guardian’s privilege to publish and distribute its newspaper. Right-on to our First Amendment.
Whether people think its articles are accurate and true is up to them.
As for the alleged criminality of The Guardian’s publisher, that is for courts to decide.
But: Janet DiFiore is one of the most incorruptible human beings I have ever met or known in my 54 years. She is a public official above reproach, and I have not been fortunate to know many others.
Read The Guardian’s articles while retaining your own skepticism.

I contacted the Guardian on friday, and was told that you mentioned in a blog as matter of fact, that Zherka is the head of the Albanian mob. I also read and was told that this was a conjoined effort, a conspiracy to not only silence free speech but to attempt to maliciously prosecute Zherka for the same speech which is guaranteed under the first amendment to the U.S Constitution.
Have you any respect for what is fundamentally the heart of our Civil Rights?
No matter what is written, unless it constitutes slander defamation or threats, its covered and protected material by our great Constitution.

Mr Edelman, the fact that you are so insistant on him losing his precious guardian is indicative of all that has been alleged.
I pulled a copy of the law suit and there are lohud.com blog entries written by you and others where as you are all acting in concert in the act of slander and defamation against Mr Zherka and the Guardian.
As far as lohud.com, i was told on friday, that you have already been identified as the blogger who slandered and defamed Zherka.
I was also told that Zherka discussed suing lohud. if they did not turn over the identifications of the slanderous bloggers. In the event you did not read the Lohud.com rules and regulations it clearly states:

The fact that Lohud did not remove those slanderous and defamatory entries by you and others automatically makes them liable. If Zherka sued them, they would be forced to either turn over the ID’s of the bloggers or sue the bloggers or name them as third party defendants in the suit. Either way I have been told that your Id has already been divulged.
Now after reading that, and reading the complaint filed by Zherka which included entries posted by you and others, I just cant figure out how you can defend that.
As far as the Manhattan ADA, Matthew Bogdanos who I read about in this weeks Guardian and his affidavits, do you actually beleive that he will tell the truth, whether under oath or not, that he participated in this unconstitutional and unlawful act. An admission of such a sort would destroy this mans career and cause his dibarment. It is beneficial to him as a friend of Janet Difiore’s and Dennis Glazers, to lie to now protect him self and his friends from civil and potentially criminal liabilities.
I am an outsider looking in and it all smells to the high heavens of a conspiracy that you have participated in.
The question is why did you, an attorney, participate with members of Amicones administration and Difiore to attempt to infringe on what benefits you, me and all of us, “Free Speech” by slander and defamation.
