Retirement Benefits Revoked For School Lawyers

As the protector of the state pension system, Comptroller Thomas DiNapoli said today he’s kicking out four attorneys from the state pension and revoking five years of service from another attorney because they were incorrectly reported as school employees with the Hamilton-Fulton-Montgomery BOCES.
The four attorneys are James Girvin, Kathy Ann Wolverton, Kristine Lanchantin and Jeffrey Honeywell, said DiNapoli.
Pension credit from BOCES for
the fifth attorney, Salvatore Ferlazzo, was revoked.
DiNapoli said his office will be returning the local government’s retirement contributions paid for the lawyers, who are all part of the same firm.
DiNapoli’s office is reviewing the pension benefits of all attorneys who have employment agreements with school districts after it was found that some Long Island schools were listing lawyers as employees, allowing them to receive pension benefits and health insurance.
“We are reviewing every lawyer in our system,†DiNapoli said. “We will revoke memberships for those individuals who have been erroneously classified as employees by participating local governments.â€










Where are the previous Comptrollers who did nothing but initiate our slide into bankruptcy? They should be indicted for nonfeasance, misfeasance, and malfeasance.
Hevesi certainly does have his own legal troubles. No wonder.
Story does not say how many school districts or BOCES have had these attorneys on the payroll for retirement benefits. The money being returned to the districts will be helpful. Does not say if anyone is in trouble for this or if it was a practice done for years.
