Dopp’s Lawyer: Spitzer Could Be Called To Testify

Michael Koenig, lawyer for former Gov. Eliot Spitzer’s communications director Darren Dopp, said this morning that he will avail himself to all legal remedies in defending his client—and that could include calling Spitzer to testify before an administrative law judge.
“We will avail ourselves of every and all avenues to defend this case,” Koenig, left, told me. “Everything in defending this case will be on the table.”
Dopp plans to fight two civil charges brought against him by the state Commission on Public Integrity that alleges he violated two sections of the Public Officers Law when he released travel records on former Senate Republican Leader Joseph Bruno’s use of state aircraft.
To fight the charges, the case will head to a public hearing before an administrative law judge. Koenig said he believes he has subpoena power to bring in anyone to testify.
The law judge, Christine Kopec, works for the commission, the Albany Times-Union has pointed out, would then issue a ruling that the commission could either accept or reject.
Then the case could head to state Supreme Court if the sides are all not in agreement.
Simply put, the case could go on for years.
