Tim…for the record I do not work for the City of Yonkers. I have nothing at all to do with Yonkers government. Many who follow politics and the media are well aware of Zherka.

And what’s going on with Zherka, the Consultant, the Manhattan D.A., the Westchester police, Janet DiFiore and NYPD has ZERO to do with newspaper boxes in Yonkers.

It’s all about Zherka trying to lay the groundwork for a defense if he’s indicted in Manhattan, in my opinion.

Is it untoward to suggest that bad elements often have a hand in strip clubs? That’s not a reflection on Zherka, of course, who I am confident runs above-board strip joints.

But then…there is also that brother of his. There is big trouble with that one. Certainly for the brother, but I’m sure Sam himself is as pure as the driven snow. Although where that snow was driven to might be another story. :)

But, it’s up to the authorities to make their case, if they can. Clearly, they are working on it. We’ll see what happens as time goes on. Sam Zherka will either be indicted or he won’t be.

As for Richard Blassberg, anyone who has seen that rag they put out knows where he is coming from. They can’t give it away, even though they try to.

Personally, I just think Zherka is starting to unravel, whether it’s due to his own problems, as Susan Tolchin said, or a combination of those problems and then listening to Blassberg —who really seems to be about six cards short of a full deck. But it’s evident his short deck does have all the jokers in it.

Tim you are correct mayor amicone’s staff did a dumb
thing,,that does not give zherka license to abuse
the justice system by suing people who he has political
issues with.you are mixing apples and oranges…
the original taking of the boxes was in fact roundly
condemned by me in public ..so zherka should have
no problem with me per se..but what you don’t understand
is that these suits have nothing to do with the
taking of the boxes…he withdrew that lawsuit..
he would not let his records be examined to determine
the extent of any damages…zherka brings a lawsuit
for one reason alone.to stiffle opposition to his point
of view..the guardian will never be a major publication
the copies are given away and are so outrageous that
he simply has lost all credibility..making him a chemist!!

I truly doubt that you are “better read” than I am. But: that may be simply owing to my being older than you. Forgive me.

Can’t ever do that! I remember porn newsstands in my hometown of LA. Circa 1978. Defensive folks tried to take those stands up, destroy them.

Result: best-sellers.

And Jiminy, we may have interacted over the past six years.

But: if you’d ignored Zherka’s Guardian two years ago, nobody would have noticed, as Mayor Amicone cruised to re-election victory.

Now: The Guardian is a major publication! Thanks to Yonkers’ attempt to thwart it.

Jiminy of course its a dumb maneuver..but think about where
he is getting his “legal advice from”...how about richard
blassberg all around political strategist who believes the
last election was stolen by janet difiore and the yonkers
police department..also believes that tony castro can win
a democratic primary….I wouldn’t be surprised if all
of this conspiracy stuff was manufactured by blassberg and
fed to zherka…after all the editorials are written by
blassberg not zherka..although zherka is ultimately responsible for the content and I can’t wait to show
a jury every single front page since the guardian
started…but I digress…blassberg either writes or
edits all of it…but little by little the public
is getting an accurate look at zherka..the new york
post called him a “boob-joint guy”..very nice don’t you
think…and remember the manhattan county da can only
investigate crimes within its jurisdiction and that
would be manhattan..they cannot come up to westchester
unless there is some nexus with the city….so one would
have to conclude that whatever they are investigating
and according to zherka it includds “money laundering”
“prostitution” and “drug dealing”..all of it specious
of course…and provoked by me…little old me…I have
the ability to “force” the manhattan da to convene
a grand jury..guess I am pretty impressive don’t you
think!!!!

Evidently, Tim Hays has no idea of what he is talking about. Anyone who reads the newspapers or follows the blogs knows it is Zherka who sues abouot half of metro NY whenever he feels like it. His lawyer now threatens to sue Mt. Vernon over Zherka’s disorderly conduct arrest.

A question…What kind of moron would show up at Mt. Vernon City Hall carrying a gun and a knife, even if the gun was registered? I’d suggest only an obnoxious, arrogant moron, that’s who.

And in the instances of suing the Consultant and law enforcement, etc., I am convinced he’s doing it to create a defense—to claim he is being “persecuted,” if he is indicted. It’s a dumb maneuver.

Also….To use your word, Tim, who has Zherka “exposed? I mean, other than the strippers in his clubs?

And if you think he doesn’t care that he is under a grand jury investigation in Manhattan —well, you are probably the only one who would think that way.

who claims to be the protector of free and unfettered speech
is using his newspaper and his personal wealth to cut off
political criticsm so he can have the field to himself

SLAPP suits work because people cannot afford expensive lawyers and, via this methodology, are intimidated by those who can; and because the public doesn’t want to pay additional taxes to defend ten thousand lawsuits often meant primarily to intimidate and squash personal opinion. Someone in a position of authority must look into this stuff and put a stop to it. If not, the wealthy, who can retain expensive attorneys and spend money profligately, will always have a loud, controlling voice, and the middle class and poor will remain speechless.

Tim what makes you think I took the guardian on…what are
you missing here…this all started when zherka announced
that he personally was going to beat amicone…and then
he spent tens of thousands of dollars to do it..he made
the announcement at a news 12 press conference…it had
nothing to do with the guardian ..and still doesn’t…
the guardian is not suing…zherka is suing personally
I never said anything about zherka’s alleged “connections”
that was said by someone else on another blog…the tribune
all I did was insist that it be verified in order to be
used in the campaign…otherwise it was rank speculation
zherka took that post and omitted all the language which
asked the author of the post ( not me) to prove what
he was alleging..8 months later zherka alleged in his
lawsuit that a grand jury in new york was investigating
him personally for “prostitution” “money laundering”
and “drug dealing”....how did he get from supporting dennis
robertson to being investigated in manhattan which as
you know is another jurisdiction..and how could he possibly
make the assertion that I was responsible for the
grand jury investigation when I have never met with or
spoken to the ada in new york..so this was never about
the guardian ..this was about zherka wanting to be
a poltical player..it was and still is about castro
primarying janet….its not about his news paper its
about defeating candidates he disagrees with which makes
it political….the only gripe he has is with the original
poster on the tribune who made the albanian kingpin
allegations in the first place.but interestingly enough
he never sought the name of the poster so we still don’t
know who it was..and neither does zherka…but having
injected himself into the poltical arena it turns out
that the law is crystal clear and he becomes a limted
public person..so essentially even the original poster
can’t be held liable unless there is a showing of
malice..but since zherka didn’t bother to find out
who it was he can’t even establish that element of his
case..but doesn’t it seem strange that of all the people
he could have sued..he chose di fiore who castro wants
to run against again and who is supported by blassberg
and Amicone who zherka wanted to beat and me…the
consultant for both of them…talk about a chilling effect
his lawsuit is merely an attempt to get me to bow out
of running her campaign for next year…he doesn’t
know me very well does he

You should, as defendant, win your suit, if our world is righteous. But then again, I was Steve Pagones’ literary agent, and Bill Stanton pounded Sharpton, Maddox, and Mason at trial, and, while affecting only a pyrrhic victory for Steve, he nevertheless won a significant verdict in American libel history.

But the main reason I use my real name in posting anything: so I don’t get carried away, and make any comments I cannot live with or have to one day defend in court.

you are missing the point Tim…it was zherka who initiated
a lawsuit..who is he exposing..you are making an assumption
that cannot be made…that is that his premise is correct
so far he has accused me, di fiore, and amicone of conspiring to provide information to the manhattan da
about his “albanian organized crime connections”..do you
believe a word of it…next he sued the police commissioner
in westhchester alleging that he was the cause of zherka’s
name appearing in the data base of the NYPD…then he
sued the city of new york…apparently on the theory that
they were responsible for “ethnic profiling’ had sam
zherka not mentioned in his own legal papers that he
was under investigation by a manhattan grand jury…I certainly would not have known…I can’t speak for the
others…I can see ignoring the guardian.,.but how do
you ignore a lawsuit that makes baseless allegations
against you which portray you as a “racist”..unless
of course you want to contribute to the cost of
paying for the lawyers necessary to defend the lawsuit
which is exactly the point of why sam is bringing these
suits.so far he has brought some 17 lawsuits against
municipalities costing the taxpayers 1.9 million to defend
does that sound like a legitimate publisher to you Tim..
have you known any other publishers who sue just for the
sake of suing …and would you lay down and allow sam
to take a default judgment against you..when you have
had absolutely no contact with the manhattan da ..
so exactly what would you do tim…wouldn’t you defend

It seems to me, to my humble lifelong Republican conservative self. . .that the greatest irony about these boards is: Sam Zherka has the best business going.

He is exposing people right and left, and is having a kick because he’s getting his purported victims-in-print to reveal themselves here on these boards. And he couldn’t care less about any indictments extant in Manhattan.

How did you guys let yourselves get played so easily?

All you had to do was ignore The Guardian, and it would have gone away.

But you didn’t. Because you were defensive.

Now, it comes back to haunt you.

I will say it again, Consultant. I believe Zherka knows he is on the radar of the NYPD and the Manhattan D.A. and is petrified he’s going down. Grand juries are not a laughing matter, and he knows that. His defense is to bully and try to intimidate. It’s a losing strategy.

He would never take an official poly test, nor do I believe they would they offer him one. At least not at this point. I think they are carefully building a “paper case” against him and may have some informants, too. That’s just my opinion. I don’t know that. And whether it will end with an indictment, I certainly don’t know.

Get used to “Chauncey Gardener” being elected next week: the Dems will win with approximately 350 electoral votes, and maybe 51% of popular vote.

The horrible, angry, unthinking white liberals, who are also stupid, will romanticize Obama. And they’ll turn on him before the end of 2009. The way friends of mine in Manhattan in the late 1980s turned on Dinkins—especially the Upper West Side lib cauc women. (“Watch out for the ‘MBAs’!”) That was delusional liberal white-speak for “male black adults.” I hate the unthinking white liberals. They’re trash.

Don’t let the stupid white liberals, even Nick Kristof in The Times, suggest to you that not supporting a Black candidate makes you racist. They are deluded. There is nothing wrong with anybody for voting against Obama. It’s not a “black thing.”

No: it’s supporting the WRONG Black candidate that leads our country into foolishness.

I have THREE friends, each of whom happens to be a “Black” Republican—each a Harvard lawyer—who would make SUPERIOR Presidents of our country.

In four years, Republicans will win the presidential election.

I was attempting to look at it from zherka;s point of view
if in fact he is of the belief that what the NYPD and the
westchester police commissioner have done to him is the
product of rumor ie that it is false..why not submit to
a lie detector under oath to prove he is not what he
claims they say he is…
now he is under arrest for bullying a policeman…and
this from the Publisher of the Guardian who holds himself
out as the honorable seeker of truth and justice..
but not as far as he is concerned…the bullying is
just an extension of what he tried to do in his first
lawsuit..rather than going after the person who originally
posted the “albanian kingpin comment on the Tribune”
he chose to go after his political agenda in suing
the consultant difiore and amicone..while he knew
very well that the consultant was not the original
poster and in fact challenged the veracity of the post
and while he also knew there was no contact between
the consultant and the manhattan da…he simply wanted
to bring a lawsuit to harass and annoy those politicians

I agree. And so does Susan Tolchin, who referred to that grand jury in her response to Zherka’s latest suit and called him a “target” of that Manhattan grand jury.

As for Zherka’s arrest, of course he was wrong to berate a cop. I think Zherka may be unraveling. I also believe these dumb suits of his are an attempt to portray himself as a “victim” in the event he is indicted in Manhattan.

category but Zherka is still a bully ..when he sued me
he chose the wrong person..unlike the mayor and the da
and the commisioner of police and the NYPD..and the members of the board of legislators and the staff of the county
executive they are all public officials and are constrained by their offices not to comment..I have no such constraints
and I intend to reveal zherka for what he really is..
once he put false accusations in a lawsuit against me
he opened the flood gates..he made a political choice
not a legal one…he was pissed off I exposed his participation in the Robertson campaign…and used
his strip club ownership to cast doubt on robertsons
motives..and his sidekick blassberg who to this day still
mentions me in his garbage newspaper as “writing divisive
pieces of mail against tony castro” is hoping to
intimidate me into not doing the di fiore campaign again
because after losing twice they know that they cannot
win with castro if I am the consultant on the other side
I have already obtained pictures of Zherka and blassberg
introducing Castro to certain members of the community
castro is making a huge error if he thinks he can win
a primary from the nominee of the democratic party…
blassberg has talked him into it..this time he will
be embarassed

apparently sam zherka was arrested in mt vernon either
yesterday or the day before and charged with disorderly
conduct..he was carrying a licensed gun and a knife.
apparently he browbeat a police officer when he
was refused entry into an auction where he had
been on the list to attend….forgeting about the
charge..does anyone think its appropriate for the
publisher of the guardian to berate a police officer
doing his job? does this reveal that zherka is in
fact a bully…do his frivolous lawsuits reveal that
he is using his money to intimidate…and is he
getting nervous with the bad press he is getting
(see the new york post article).and the pending
grand jury investigation?

One thing that must be going on is that Mr. Zherka’s brother Ali has a prior criminal record, and he is currently under indictment for crimes with Albanian mob connections. That is according to the Federal indictment of Ali Zherka, which dates to the summer of 2007. Among those arrested with Ali Zherka was a New York City police officer named Moonan. Considering those facts, it is not at all surprising that the NYPD and the Manhattan District Attorney are looking at Ali’s brother, Sam Zherka.

the funny thing is that if sam zherka is so interested
in proving that he has no relationship with “albanian
organized crime” it seems to me he could do it in
a lot of other ways other than starting these lawsuits
and making allegations and assertions that have no
basis in fact..for example he could walk into NYPD
and say “ask me anything you want….or he could take
a lie detector test” which I would pay for by the way
because I in fact have no knowledge of any oc involvement
and sympathize with anyone wrongly accused…so I can
understand why he might be upset.but I don’t think any of
us knew about the grand jury investigation until sam
himself put it in his own lawsuit…I certainly didn’t
have any idea about any albanian oc connections because
when someone on the blog wrote it I immediately challenged
that person to prove it…which obviously demontrates
skepticism at the very least…so there is something
else going on here ..maybe sam is being sold a bill of
goods by blassberg…as to how to handle this in the
american justice system..but his attorney should know
better…and sam could easily disprove the rumor and
get his name removed from the data base
