Judge Rejects Democrats’ Injunction

A state Supreme Court judge this morning rejected Democrats’ request for a temporary injunction, saying he doesn’t have the legal authority to rule on a legislative action.

Judge George Ceresia said if he had the authority, he would have ruled to issue a temporary injunction in order to allow Democrats and Republicans to come to some agreement. He sought to have the sides reach some compromise on a temporary deal, but they were unable to do so.

“I don’t have the power to issue a restraining order,” the judge said.

The decision meant that Republicans went forward this morning with a brief and raucus session.

The Democrats’ larger legal case that Republicans illegally voted to install new leadership will be heard tomorrow morning in Albany court.
