Coup To Be Decided In Court Monday

A state Supreme Court judge this morning said he would rule Monday on whether a coup by Senate Republicans was legal, but admonished the sides for not reaching agreement themselves.

Senate Democrats were in court to block Monday’s overthrow of Senate Majority Leader Malcolm Smith, D-Queens. Senate Republicans sought to dismiss the case, but Democrats are objecting.

Judge Thomas McNamara said in state Supreme Court in Albany this morning that he would rule in advance of Monday’s planned 3 p.m. session whether the overthrow was legal.

Democrats claim the attempt to install Sen. Pedro Espada, D-Bronx, as temporary Senate president and Sen. Dean Skelos as majority leader was illegal.

McNamara took offense to comments that the coup is heading to a judiciary merry go round to be resolved.

“This matter has an importance to it that certainly has a theater to it and a drama to it and an absurdity to it, to be quite candid, but it’s important, it’s important to the people of the state,” he said.
