Democrats Won’t Appeal Ruling

After attorneys said earlier in the day that they would appeal today’s ruling in state Supreme Court, Senate Democrats announced this afternoon that they won’t appeal.

Senate Democratic Leader John Sampson, D-Brooklyn, said the judge’s decision spells out that the Senate leadership must resolve the dispute and that’s what they intend to do. Sampson said Democrats put together a power-sharing agreement, but Republicans won’t agree to it.

“Basically the judge said here, you deal with the quagmire,” Sampson said. “The court is not going to deal with it. We have to deal with that quagmire.”

But Republicans said state Supreme Court Judge Thomas McNamara dismissed the case, so that means Republicans’ coup last week stands.

“Judge McNamara dismissed the case,” said Sen. Pedro Espada, D-Bronx. “And in any language and in any interpretation, that means that the 32-30 vote …must be honored, must be respected.”

So the stalemate continues.
