Gavel In, Gavel Out

The fifth day of special sessions in the state Senate today ended the way the others have: Neither side had 32 votes to pass any legislation.

So has they have in past days, each side gaveled in and gaveled out within minutes and they left.

The warring sides said they will continue to meet through the weekend to try to end the gridlock that has hit the chamber since June 8.

A larger group of Democratic and Republican senators are meeting later today behind closed doors after Democrats yesterday rejected a plan that would have made Sen. Malcolm Smith, D-Queens, Senate president. Smith was ousted as majority leader in the coup.

Sen. Pedro Espada, D-Bronx, who has joined with Republicans, said this afternoon that progress is being made toward a resolution.

“We’re aware of what embarrassment we brought our state and our institution,” he said. “We’re going to correct that.”

    Her husband and one of her two sons were outside, along with the family’s black Lab, Stanley. With the stately manse as a backdrop, the petite, blond lawmaker and her family could have been modeling for an L.L. Bean catalogue.
    There was one problem with the pretty picture: Carrozza’s $1.8 million home is in tony Glen Head, L.I. – 15 miles from her district in Bayside, Queens.
    Carrozza, 42, who has represented the 26th Assembly District since 1997, bought the mansion on Nassau County’s Gold Coast in June 2008, taking out a mortgage for $1 million, property records show.

    ?The election of Washington Hunt on 2/17/1849 (See Assembly Journal pg 507)?was the first time Sec 41 was used.
    This Sec was passed into law because of the resignation of Millard Fillmore (See Assembly Journals

    1/31/1849 pg 280 (letter from Millard Fillmore) Gentlemen-Anticipating that my duty may soon compel me to resign the office which I now hold, and being anxious to avoid any inconvenience which might result from a vacancy, I thought that the public interest would be best consulted by a resignation to take effect at some future day, which should not only give time for the Legislature to pass a law for filling the vacancy, but also allow him time to reach the capital before I leave I therefore respectfully resign on the 20th day of February next.?I cannot suffer the opportunity to pass without expressing to you my heartfelt thanks for the courtesy and kindness which on your part have market all our official intercourse.

    On 2/17/1849 (Pg 507) The hour of 1pm having arrived, In pursuant of the statute in such case made and provided, and of a concurrent resolution of the two houses, the Senate attended in the Assembly chamber, and proceeded to elect by ballot a person to fill the vacancy which will occur in the office of Comptroller on the 20th inst, occasioned by the resignation of Millard Fillmore and the ballots having been taken and counted, it appeared that Washington Hunt received 89 votes?Charles A. Mann received 15 votes, Nathan Dayton received 7 votes, and William S. Johnson received 1 vote.
    Whereupon. Washington Hunt received a majority of all the votes cast was declared duly elected Comptroller in place of Millard Fillmore resigned.
    Then Senate then, withdrew from the Assembly chamber.?==================================
    The first election under this section was by “Joint Ballot” not “Viva Voice”
    Thus any and all elections that took place “Viva Voice” and not by “Joint Ballot” would seem to be “Noll & Void”

    Mason’s Legislative Manual Sec 536 Voting by Ballot

    If one looks back into other elections under this section one will find that they voted by Viva Voice and not by “JOINT BALLOT”

    It would seem, they all were not “ELECTED” This would seem to hold for any Law (Sec 202 Education) that says election by “JOINT BALLOT”
    That is why I believe that Tom DiNapoli election is a nullity, since he was elected by “VIVA VOICE” and not by “JOINT BALLOT”

    club owner to subsidize the website that the politician
    has set up…it is putting ones personal agenda first
    particularly when the person who owns the strip club
    is under criminal investigation in new york

    Raising taxes by 15% a year then pretending to be a tax cutter? Do you think the voters are stupid?

    You talking about recalling others but hanging with the strip club crowd. Do you think the voters believe that line of malarkey? Do you think the mothers of little girls want their politicians to spend their time with men who make their money from the lap dances teenagers give to fat men and call it just another life-style choice?

    Do you support your good friend as he files lawsuit after lawsuit after lawsuit against small towns which cost more and more and more every day to defend?

    Do you love the lawsuit against the public library?

    Gee, Paul, I never heard that you stood up in public to oppose these frivolous and wasteful lawsuits that hurt the citizens of Westchester. I only saw pictures of you standing beside the strip club owner that filed these costly suits.

    Do you represent the views of your constituents or the views of the strip club crowd?

    Really Paul? Do you actually in your heart have that much contempt for the intelligence of the American People?
