In Joint Session They Will Go

June
30

A state appeals court ruled this afternoon to uphold a lower court’s ruling Monday that all 62 senators must meet jointly during special sessions called by Gov. David Paterson.

The decision upholds state Supreme Court Judge Joseph Teresi’s ruling Monday that it is illegal for the warring senators to hold separate sessions.

Then again, neither ruling compels the Senate to take any action when they get into the chambers, which as today’s morning session indicates means they can all simply gavel in and gavel out.

GOP lawyer Jack Casey suggested this morning that the case could end up being appealed to the state’s highest court, the state Court of Appeals.

Here’s the decision.
