Schorr wants independent prosecutor on Conservative vote

Dan Schorr, the Republican candidate for Westchester County District Attorney, is calling on Janet DiFiore, the incumbent Democrat, to appoint an independent prosecutor to look into claims that there was fraud and forgery in the Conservative Party’s nomination of County Executive Andrew Spano.

The Conservative Party has filed several lawsuits, including one yesterday, alleging that Conservative Party leaders forged as many as 80 or more signatures that gave Spano the line. They want Spano off the line.

DiFiore also received the Conservative Party line.

Schorr is holding a press conference today.

    Schorr is making himself look like a used puppy dog. Following the orders of dissidents in the Conservative Party. The residents of Westchester understand that this is all about politics and jockeying for position. Schorr feels any press time is free air time, Schorr is showing that he will carry the water for others if told to do so.

    Unfortunately Dan is demonstrating his lack of understanding
    of the criminal justice system..there may indeed be fraud in
    the petitions..on the other hand there may not be…the first step is that the supreme court justice colabella
    will make a determination if the conservatives have a valid
    convention and candidate…then if he finds that there is
    any indication of fraud he can refer the issue to the office
    of the district attorney for action…and she can either
    take the case or appoint a special prosecutor..what schorr
    is doing is totally uncalled for without proof positive in
    court that petitions were fraudulent ie intentionally
    forged…for anyone running for da to make the call for
    a special prosecutor at this point in time is an indication
    that they put their political interests above normal
    judicial process…its like saying someone is guilty of
    a crime even before the grand jury indicts..this kind
    of poltical chicanry should be roundly rejected by the
    voters

    Good for Dan Schorr! It’s time that someone called it for what it is: Criminal.

    Westchester politics has been sleazy for years. Just like Jersey politics. Those special prosecutors should come here next.

    Forgery is AGAINST THE LAW.

    Zherka and Castro’s relationship is of bigger concern to me right now. How can a candidate for District Attorney (Tony Castro) pal around with a strip club owner who is under federal investigation for crimes they suspect he engaged in? Why hasn’t Dan Schorr or the commented on the friendship between Zherka and Castro, does Schorr think their relationship is good for Westchester County?

    forgery is against the law..but first it has to be established that there is indeed forgery….and that
    there is so much forgery that it invalidates the
    outcome…then you get your prosecutor, not before

    A prosecutor INVESTIGATES alleged crimes, Jeff. Since when does a DA come in only after a case is proved.

    Conservative Party members are alleging that a crime occurred. The crime of forgery in this case. Any decent DA should want to investigate that.

    in election law cases..fraud is always alleged..in this
    case the conservative challengers have chosen to file
    a civil lawsuit in which they will have to substantiate
    the allegations of fraud..the judge will make the initial
    determination and then if there is evidence of pervaisive
    fraud AFFECTING THE OUTCOME OF THE CONVENTION…it will
    be referred to either the DA or the AG as it should be..
    do you by the way also think a prosecutor should look
    into the relationship between a person already under criminal investigation in manhattan and the candidate
    he supports for chief law enforcement officer in westchester

    An aggrieved party can ask the DA to investigate. But when that DA is conflicted, he can call for an independent prosecutor. The judge can do that, too.

    thats correct but it will not and should not happen
    until the judge decides whether or not there is
    intentional violation of the election law…otherwise
    in every election small and large the da would be using
    resources that are being wasted on political charges

    Dan Schorr is hardly your average petitioner. He is a former New York City and Westchester prosecutor with a Harvard law degree. He knows the law.

    Too many posts here analyzing the composition of a raindrop during a flood. The point is that the Conservative Party has been cynically hijacked and the huge bulk of conservative voters disenfranchised and the endorsement of a county’s right of center populace overridden in the gift of a few manipulators’ endorsement to a liberal Democrat. If this isn’t crystal-clear to anyone with an IQ over 80, on either side of the political spectrum, they’re taking dumb-pills.

    My oh my, what will Ms. DiFiore do now??? Bite the hand that feeds her or keep her head down and hope that this goes away? She’s gotta say something, I doubt Schorr will let her off the hook easy on this one. I guess its the price you pay when you cut deals to protect your political hide.

    So Jeff, are you saying DiFiore can ignore this request, even though doing so would directly benefit her?

    She HAS TO respond to this. Ignoring it is unethical.

    nope I am saying that Judge Colabella will decide in court
    whether there is reasonable grounds to believe that pervaisive fraud exists and whether in light of that fraud
    if it exists, the conservative choices for county
    wide office are null and void…he then can refer the case
    to the da’s office and the da can either investigate
    the circumstances or ask that a special prosecutor be appointed….no request for a criminal investigation is
    ripe until the civil complaint is decided…and for your
    information ms difiore does not need the conservative party
    to win this year…democrats outnumber republicans by
    120,000 maybe by more come november..and schorr cannot
    get the line…nor does he have the IND line..so the
    election will be a foregone conclusion..andy spano on the
    other hand has a tougher problem if he looses the line
    which I sincerely hope he does

    News 12 is reporting that DiFiore has notified Andrew Cuomo’s office about the forgery allegations.

    Could be VERY bad news for Andy Spano.

    So, Jeff, unlike you, Janet DiFiore didn’t think it was necessary to wait for the Civil Court Judge to rule. She did the right thing and asked the State Attorney General to look into the alleged fraud.
