After Taconic Crash, Senator Proposes Tougher DWI Laws

After the Taconic Parkway crash last month, Sen. Charles Fuschillo, R-Nassau County, today introduced legislation that would make it a felony if people are caught driving drunk with a child in the car.

“A child in a car driven by a drunk driver is a defenseless hostage in a dangerous situation. Most children are too young to take the keys away or call a cab,” he said in a statement.

The legislation states:
—Individuals who drive drunk with a child under the age of 16 in the car would be charged with a class E felony and face up to four years in prison and/or a fine of up to $5,000;
—The aggravated vehicular homicide law to include drunk drivers who kill a child under the age of 16. it would also raise the penalty for aggravated vehicular homicide to a class B violent felony punishable up to 25 years in prison;
—The aggravated vehicular assault law would include drunk drivers who seriously injure a child under the age of 16 and raise the penalty for aggravated vehicular assault to a class C violent felony punishable up to 15 years in prison.

    Senator, I E mailed you the following, I’ll back this law when I see the word “Mandated” in order that some Atty cannot plea down , or try to dismiss these charges.Pay no attention to the mush for brain comments that preceded this.I was some what stunned to see that mail was returned to me with out you or a staff member ever casting an eye on it.N.Y.S. likes to play the fact that it’s tough on Drunk Drivers but it is Lax.Prison time for these “HIGHWAY TERRORISTS” will keep them off the States Highways because they cant drive in a prisons exercise yard.Other States are waking up to the seriousness of this D.W.I. lax punishment s and are doing something about it, and they are putting teeth into that. 300+ and 7,000+ were Killed and injured here in N.Y. S. in 2007, Way more than by any Gun!, and no one gets real serious about it.You and your buddies in the Assembly and Senate have lost a few votes and still a non caring subject for the politicians
