State appeals ruling in adult-home case
The state filed an appeal today with the U.S. Court of Appeals, 2nd Circuit, in an adult-home lawsuit, two days after U.S. District Court Judge Nicholas Garaufis issued a ruling that said the state’s plan to develop supportive housing for adult-home residents is not adequate. He ruled in September that the roughly 4,300 adult-home residents in New York City were not being cared for in the most integrated setting, a violation of federal law.
Garaufis’ ruling Monday gave the state four years to provide housing in community settings for residents of adult homes in New York City. He ordered that the state develop at least 1,500 beds a year for the first three years, and after that, 1,500 beds a year until there are enough for all residents who want to move into community housing.
The remedial plan submitted by the state called for a total of 1,000 new housing units between 2011-12 and 2015-16 for seriously mentally ill adult-home residents who are able to live independently.
The remedy in the case is expected to have implications for the roughly 12,000 residents of 380 adult homes across the state, and possibly outside New York.

Unfortunatly, the Garaufis ruling is very bad for the mentally ill. They make it sound like this is a “victory” for residents living in adult homes. The only winner in this is greedy supported housing providers who will now get more customers for their taxpayer funded apartments. For Adult Home residents this ruling is a threat to their homes and current services. Its so sad when advocates prey on the most vulnerable people. And this judge….what an idiot…
Unfortunately, it is the adult home providers who have preyed on adult home residents, treating them more like cash cows than human beings. This is real chance for freedom and dignity for current adult home residents. It is a shame that the state is appealing; an indication perhaps of the tremendous and nefarious influence of the adult home provider industry on state government nowadays.
