Updated: Borkowski dismisses plagiarism counter-claim by Katz in 99th AD race
Plagiarism charges continue to fly in the 99th Assembly District race.
Just a few days after nominee Jim Borkowski, R-Southeast, called on likely primary opponent Steve Katz of Yorktown to step down over campaign website content that resembled an online editorial, the Katz camp is firing back.
His campaign points to extended passages on Borkowski’s website that resemble or outright mirror those from the campaign website of upstate Republican Assembly candidate Ken Blankenbush
Blankenbush is running to succeed Assemblywoman Dede Scozzafava, who is not seeking reelection following her high-profile but unsuccessful bid last fall for New York’s 23rd Congressional District seat.
Blankenbush did not respond to requests today for comment. Borkowski asked to review the allegations before commenting.

In one instance, Borkowski’s site contains the following paragraphs on education reform that differ by only a few words (bolded in the second paragraph) with passages found at Blankenbush’s website as well as a press release he issued that ran at the Watertown Daily Times political blog on June 24.

A few other similarities between the two candidates’ sites and the press release are not quite as obvious.
For instance, sentences found at both sites under the heading Property Tax Cap are nearly identical. And both Blankenbush’s site and his published release list categories of reform titled Spending Cap, Property Tax Cap and Debt Freedom Act, and each is followed by similar though not identical phrasing to the same items at Borkowski’s site.
Lastly, a section on election reform at Borkowski’s site contains a sentence — “This encourages fresh thinking and eliminates career politicians.” — that also appears at Blankenbush’s campaign site and in his published press release under the heading Term Limits.
Earlier this week, Borkowski called on Katz to step down from the race after The Journal News published an article in which Putnam Democratic Chairwoman Lynn Eckardt cited similarities between Katz’s website and a March 7 opinion piece published online by Crain’s New York Business.
And earlier this spring, departed Peekskilll Democratic Chairman Darren Rigger accused Yorktown Councilman Nick Bianco, then a candidate for the Republican nomination, of of submitting an op/ed on health-care reform that Rigger said was condensed from financial adviser and radio host Ric Edelman’s newsletter.
Bianco denied the charge. Unlike Katz, he dropped out of the race after Borkowski won the nomination.
Borkowski responds
Asked about the striking similarities between some of his materials and Blankenship’s, Borkowski said he prepared his own campaign materials himself and spent a great deal of time and thought on research and meeting with elected officials and voters.
He said he relied on the Republican Assembly Campaign Committee, which he said serves as a “sounding board” for candidates. He said he has never met Blankenbush.
“The positions I take are my own positions,” Borkowski said. “RACC assisted me in preparing my platform.”
Borkowski said what Katz did with was to steal language from a for-profit publication, pass it off as his own and then blamed an unnamed staffer.
“To my mind, if a candidate doesn’t think the issues are important enough to think about for himself he’s not prepared to run for office,” he said.
Katz campaign spokesman Bill Bongiorno said Katz’s only motivation in this race is to help solve the problems facing New York State and that he thinks the facts should come out about the candidates so the people can decide.

Blankenbush and Borkowski are both clearly being supported by the Assembly Republicans so that would explain the platform similarities. I hardly consider this a case of plagiarizing. Perhaps its ideologically lazy, but plagiarizing it is not.
Katz, on the other hand, purloined whole passages from an online newspaper article and inserted them without attribution into his platform as if he had written it himself.
It would almost be a certainty that Albany would condone Borkowski’s and Blankenbush’s use of their platform. In fact, they probably encourage it.
WOW! Bianco copies page, Katz copies two sentences, Borkowski copies ten paragraph; Slick Nick, Copy Katz and Judge Dredd! I wonder what paid Borkowksi consultant Mike Edelman will have to say when we replace Katz with Borkowski:

Within the collegiate academia in which I participated, the “joke” going around was “Copy from one, it’s plagiarism. Copy from two, it’s research.” Plagiarize or perish.
why was the original bianco or katz story news-worthy and why is this story considered news-worthy? the journal news must really be hard up.

And this is the guy who’s his own man? This is the guy with maturity and good judgement? Borkowski claims he’s the one who represents the working guy, the common man? Yet the political machine is writing his platforms for him??

That’s what happens when somebody runs for office who craves power too much, as Borkowski clearly does.
I thought something was strange when I received Borkowski’s mailer the other day (where he calls himself Judge), and today I received Mary Beth Murphy, and it was clear they were written and prepared by the same person or company.
Notice how James Borkowski hasn’t bragged about his close relationship with Senator Vinny Leibell? Notice with 2 months to election day, Borkowski and Leibell haven’t done joint anythings together? Even though Leibell is the one who got Borkowski all those little blank proxies at the GOP convention (the same convention where Borkowski claims he recieved “overwhelming support”). And Borkowski had been begging, begging and begging Leibell to support him for something, ANYTHING, because Borkowski really needs a job.
Why doesn’t Borkowski come clean and tell everyone about his relationship with and sponsorship by Vinny Leibell? Why is it that Borkowski has been actually trying to distance himself from Leibell? (an impossible task, by the way).
When Katz calls on Borkowski to release the results of the investigation by the Commission on Judicial Ethics, will Borkowski do it? Or will Borkowski just keep lying and saying he resigned from the town court without any investigation? If Borkowski is going to keep identifying himself as JUDGE, then he needs to come clean about his conduct as JUDGE.
And Jim, how’s that CIVIL RIGHTS LAWSUIT coming, by the way?
For Borkowski to blame this on RACC shows how much of an Albany insider Borkowski will really be if elected (heaven forbid!)
Borkowksi was never a Judge. He was a Town Justice. The term is “Justice Borkowski.” The phrase Judge is pejorative.

If Katz wants to win this he needs to pull back the veil on Judge Jim. Behind the handsome smile is a man of low moral character, who will do anything, say anything to get elected to anything. First Sheriff, then Senate and now Assembly.

DiFrancesco, while working for Greg Ball as Chief of Staff, was sending the Leibell camp sensitive and private information from Greg Ball’s private computer, and he was doing this all behind Ball’s back for many months. Ball has all the e-mails and has presented them in powerpoint presentations. This is treason and treacherous no matter how many insults you want to sling against Ball. Try to dismiss it by calling Ball names…that seems to be the only desperate thing you guys have available to you. DiFrancesco running Borkowski’s campaign is a decision that Borkowski made, and is an insight into what kind of insider Borkowski is. Bought and paid for by Vinny Leibell. Borkowski and DiFrancesco, they both need jobs badly, and this is Leibell’s way of trying to provide them. If Borkowski wants to derive the benefit of calling himself JUDGE, then he is going to be called on by Steve Katz to release the findings of the investigation by the Judicial Commission. I don’t know why Borkowski continues to play this insanity that nothing happened and that all is well; every lawyer in this town knows all about it, and many other people as well. And that’s the least of his problems. The Katz campaign has done its homework and has the ability to deliver. There is a lot that Bork doesn’t want to admit to but soon will have no choice.

“Vote Katz” is dead on in his assessment! How does the expression go “show me who your friends are and I will know who you are.” Judge Jim’s choices and actions say more about his character than words. Katz from what I’m told has a strong bank account to commit to this race. Borkowski has Leibell behind him, which up until recently was supposed to be a positive. We’ll see how that plays out. If Leibell takes a fall, and by all accounts it appears he will, then it shouldn’t hurt Borkowski at all if he plays it right.
I, too, heard about some problems may be upcoming for Borkowski and DiFrancesco.
The numbers have been posted here before, Borkowski polled worse then John Degnan during his Sheriff’s race in 2009 in Carmel, Patterson and Southeast. So to say that he has a high name ID when he drew less votes than John Degnan is not really accurate, or, the name ID is negative.
Borkowski has more or less the same name recognition than Katz in the rest of the district which is Dutchess and Westchester. Katz has already sent five mail pieces, Borkowski sent one (and put the stripes in the American flag in black/white, which I found to be in poor taste).
Katz started the race with $150,000 so the small advantage Borkowski had in name recognition is erased by Katz’s ability go mail and go on TV.
John Degnan and The Truth About Greg Ball spent $750,000 on that primary, I don’t think Borkowski is going to be able to get that kind of money from Leibell this go-round.
Katz also has the endorsement of the Independence Party and will probably wage a successful opportunity ballot for the Conservative line as the “tea party” candidate and since the Dutchess and Westchester Conservative parties will not help anyone associated with Leibell.
In the past primary elections in Putnam for Ball, and Ball’s candidates in local elections, they poll at 60-70%, the question will be is how much support will Ball really put behind Katz, will he have access to Ball’s donors, volunteer base, etc. Obviously if the answer is yes, then Katz will win easily. If Ball hesitates to focus on his own race, then I think the race will be very close.
Putnam outvotes Dutchess and Westchester 2:1 in these primary elections, even though it makes up less than half of the district, so whoever spends the most time in Putnam will win.
Katz has the advantage of being from the Mohegan Lake/Jefferson Valley/Lake Mahopac/Baldwin Place/Heritage Hills area which has the biggest Republican margins, which is also home to Don Smith, who is no friend of Borkowski. Smith polled 80% in most of Carmel, and will probably campaign hard against Borkowski.
I saw Borkowski outside the A&P a couple of times, Katz knocked on my door in Peach Lake, they’re both going through the motions and I think Mike Edelman is correct when he states that people don’t really care who someone’s campaign manager is and what they’ve been accused of. That may cost Borkowksi in some circles, but not with the voters.
I for one would like to see a campaign based on the issues for a change, both Katz and Borkowski have stuck to that so far until Borkowski came out with this ridiculous claim for Katz to step aside (which was made even more ridiculous when it turned out his entire platform came from RACC, although not their mailing permit – why?) and I hope going forward this race will be a positive one since we can expect non stop negativity in the Murphy/Ball/Kaplowitz and the Hall/Hayworth races – but I’m not holding my breathe.

Tell borkowski to release the results of the judicial ethics investigation from 2008. There’s no implication there, but a real investigation that borkowski is not going to be able to refute. Along with several other issues.

Two Republican Assembly candidates — one from here and the second downstate — have touted plans to fix New York that are, in a dozen instances, exactly alike.
With neither alleging plagiarism by the other, it appears both Kenneth D. Blankenbush and Jim Borkowski took statements created by the Republican Assembly Campaign Committee and released them without changes.
Mr. Blankenbush, Black River, said his “True North” plan, released June 24, was an amalgamation of ideas from several sources.
“I listed a lot of the things that bothered me that I would want to put in a platform,” the Jefferson County Legislature chairman said. “Then I talked to a lot of people: neighbors of mine, my friends, small-business people. And I had some meetings with farmers, meetings with local Republicans and the Assembly Republicans that I talk to.”
The 122nd Assembly District candidate said he was given about 10 pages of ideas from “Assembly Republicans” and added: “I’ve used some of their wording, the ones that I’ve agreed with.”
Mr. Blankenbush said he doesn’t know Mr. Borkowski or “where he got all of his information, but it must have been from the same place.”
Mr. Borkowski, who is looking to represent Dutchess, Putnam and Westchester counties in the Assembly, reportedly released his plan via his campaign website Friday.
The two candidates made identical statements on a state spending cap and how to take votes on future debts, creating greater oversight of state agencies and authorities, unfunded mandate reform, denying state pensions to convicted felons, requiring legislators to disclose outside income, instituting term limits, calling for special elections within 100 days of vacancies and consolidating the state’s economic development plans. They also held a nearly identical position on a state property tax cap. Mr. Blankenbush called for the annual increase not to exceed 2 percent or the rate of inflation, while Mr. Borkowski offered 2.5 percent.
Mr. Borkowski told The Journal News that he prepared the plan himself after consultation with elected officials and voters.
“He said he relied on the Republican Assembly Campaign Committee, which he said serves as a ‘sounding board’ for candidates,” the paper wrote on its Politics on the Hudson blog. ”’The positions I take are my own positions,’ Borkowski said. ‘RACC assisted me in preparing my platform.’”
Mr. Blankenbush included ideas in his plan that Mr. Borkowski did not. The north country candidate had five ideas to “cultivate New York’s family farms,” an issue with greater priority in the district here than the one Mr. Borkowski hopes to represent.
Mr. Blankenbush also included proposals to withhold a Miranda warning to terrorism suspects, protect Second Amendment rights and institute tort reform.
What did you expect from a guy who got all his Republican convention votes not from true, grass roots support but rather from Ray Ray making phone calls non-stop for four days, getting blank proxies from the Putnam committee members, most of whom owe Uncle Vinny for their jobs? Ray Ray gets all these blank proxies from dozens of committee members, Ray Ray writes in the name “BORKOWSKI” on all of them, and Borkowski gets the most votes. Then Borkowski claims he’s the “overwhelming choice” of the GOP? How phony can this be? And he calls on Steve Katz to not run because of it?
Let me tell you something about the Katz campaign. Katz has by far the most money, the most resources, the stronger team, and far less negatives. Most importantly, Steve Katz has no association or link to Senator Leibell, whereas Borkowski is joined at the hip with Leibell. Gonna be interesting to see how this and the Mary Beth Murphy elections play out when the federal hammer drops.

Candidates should chart their own course

Two Republican candidates for Assembly, one local, another from downstate, appear to be working from the same playbook.
Kenneth D. Blankenbush of Black River, a candidate for the 122nd Assembly District, has expressed many of the same ideas for governing as Jim Borkowski, who seeks to represent Dutchess, Putnam and Westchester counties.
The two hopefuls seem to agree completely on a number of issues — a state spending cap, voting on future debts, oversight of state entities, unfunded mandate reform, term limits, and the list goes on.
Although the two candidates do not know one another, their campaign materials express many of the same ideas and even use similar wording, identical in some cases.
The playbook is being written by the Republican Assembly Campaign Committee (RACC). Even though both candidates said they formed their ideas through conversations with citizens and friends, meetings with party members and elected officials, and assistance from the RACC, their reliance on the latter appears to be excessive.
Voters are not looking for candidates who will repeat the party line, embrace the party’s solutions and adopt a party committee’s ideas as their plan for governing.
People who seek elective office need to think independently, study the issues critically, draw their own conclusions and prepare their unique plans for governing.
Consult with all knowledgeable parties, by all means. But candidates should resist attempts by Republican or Democratic conclaves to co-opt them, dictate the election agenda and provide answers for the party slate to parrot.
Voters are looking for independent-minded leaders who will bring fresh ideas and solutions to the many challenges facing this state. To reform state government, original thinking will be required.

It’s almost comical, both Mr. Borkowski and Mr. Blankenbush claim that RACC wrote their platforms after they consulted with local residents. In fact, the answers they gave for the various media inquiries about consulting with local residents were almost identical. I wonder if RACC also wrote their answers to the media for them? Is that why Mr. Borkowski had to call back the reporter before he could answer the allegations that (even though he “consulted with local residents”) his ENTIRE platform was someone else’s?
It seems Borkowski should have checked his own closet before trying to expose someone else’s.
Today I received an EXCELLENT piece of mail from Steve Katz. Pro-gun, pro-life, pro-lower taxes, all pre-dating his run for office. Sincerity, in other words. The real deal. He pointed out that Borkowski last year in the sheriff race accepted and ran on the Working Families Party line, and also pointed out everything the Working Families Party stands for.
The WORKING FAMILIES PARTY ENDORSED JAMES BORKOWSKI. He knew what their platform was when he graciously accepted their nomination (an endorsement arranged by fat Rob DiFrancesco who incidently, along with Borkowski, I hear may be in a bit of trouble).
Borkowski (R, WFP) can’t dismiss the endorsement of THE WORKING FAMILIES PARTY. Conservative Republicans won’t allow it.
Its more than just Don Smith that has an axe to grind. I also recall the judicial investigation from last year pertaining to an abortive run for County Court Judge. Its not this $14 million civil suit.

Matty…to be fair leibell didn’t support Borkrowski for district attorney, not even close, Mr. Senator Leibell smelled judge judy’s money from 10 miles away and saw a fat opportunity to make some cash off Adam Levy, I think Borkrowski was going to run for DA & maybe someone else too, then we have an agreement between Levy and Leibell chief of staff McGuire for a $75,000 consulting contract, and suddenly the DA race was uncontested. anyone who thinks that’s not what happened, I have a bridge in Brooklyn I’d love to sell you, Levy has lost a lot of freinds this past 3-4 years due to the way he’s conducted himself in office, & he knows itBorkrowski should have run anyway, he should run for DA when Levy is up for re-election, i think this year. Tell him, I walked away once, I’m not doing it again.

seriously is Katz running for senate, or not? I read many of these posting from 18 months back. Vinny Leibell and Ray Maguire are both in federal prison.
