Court decision expected Tuesday on Westchester contracts board

After hearing Monday morning from lawyers for Westchester County Executive Rob Astorino and the Democratic leadership of the Board of Legislators, Judge Barry Warhit said he will issue a decision Tuesday by 4 p.m. on whether to continue a restraining order in a dispute over the membership of the county contracts board.

The Board of Legislators passed a law in November replacing the DPW commissioner with the Budget Director on the Board of Acquisition and Contract. In December lawmakers overrode Astorino’s veto. The law took effect in February but DPW Commissioner Jay Pisco continued to sit on the board until Warhit issued a temporary restraining order March 29 canceling that week’s meeting of the board.

The Astorino administration has argued the change to the board requires a referendum.

An appeals court allowed the board to meet last Thursday with the two undisputed members, Astorino (or in this case his representative) and BOL Chairman Ken Jenkins. The lawyers are scheduled to return to the appeals court Wednesday.

Warhit set a briefing schedule on the underlying arguments for May and a conference for June 19 at 2 p.m.
